America's War on Same-Sex Couples and Their Families is a legal, political, and social history of constitutional amendments in twenty American states (with 43 percent of the nation's population) that prohibited government recognition of all forms of relationship rights (marriage, civil unions, and domestic partnerships) for same-sex couples. Based on 175 interviews with gay and lesbian pairs in Georgia, Michigan, North Carolina, Ohio, Texas, and Wisconsin, the volume has great human-interest value and chronicles how same-sex couples and their children coped within harsh legal environments. The work ends with a lively explanation of how the federal judiciary rescued these families from their own governments. In addition, the book provides a model of the grassroots circumstances under which harassed minority groups migrate out of oppressive state regimes, together with an estimate of the economic and other costs (to the refugees and their governments) of the flight from persecution.

A compelling and timely vision for gay reparations in the United StatesIn the last two decades many nations have adopted "gay reparations," or policies intended to make amends for a history of discrimination, stigmatization, and violence on the basis of sexual orientation and gender identity. Far from being a homogenous or uniform phenomenon, gay reparations encompassa small constellation of approaches including a formal apology to the LGBT community for past wrongdoing, financial compensation for victims of anti-LGBT laws and actions, and the erection of monuments to the memory of those who suffered because of structural homophobia. The United States, however,has been reluctant to embrace gay reparations, making the country something of an outlier among Western democracies.Beyond making the case for gay reparations in the United States, this book explores a wide range of questions provoked by the rise of the gay reparations movement. Among these questions, three stand out for what they reveal about the puzzling and complex nature of this new front in the struggle forLGBT equality. Why, after centuries of attempts to marginalize, dehumanize, and even eradicate LGBT people, are governments coming around to confront this dark and painful historical legacy? These foreign experiences reveal potential pathways for gay reparations in the United States. More importantly, they showthat while there is no universal approach to gay reparations it is never too late for countries to seek to right past wrongs.

In Everyday Violence against Black and Latinx LGBT Communities, Siobhan Brooks argues that hate crimes and violence against Black and Latinx LGBT people are the products of institutions and ideologies that exist both outside and inside of Black and Latinx communities. Brooks analyzes families, educational systems, healthcare industries, and religious spaces as institutions that can perpetuate and transform the political and cultural beliefs and attitudes that engender violence toward LGBT Black and Latinx people.

The advancement of LGBT rights has occurred through struggles large and small-on the streets, around kitchen tables, and on the Web. Lawsuits have also played a vital role in propelling the movement forward, and behind every case is a human story: a landlord in New York seeks to evict a gay man from his home after his partner of ten years dies of AIDS; school officials in Wisconsin look the other way as a gay teenager is repeatedly and viciously harassed by other students; a lesbian couple appears unexpectedly at a clerk's office in Hawaii seeking a marriage license. Engaging and largely untold, From the Closet to the Courtroom explores how five pivotal lawsuits have altered LGBT history. Beginning each case narrative at the center-with the litigants and their lawyers-law professor Carlos Ball follows the stories behind each crucial lawsuit. He traces the parties from their communities to the courtroom, while deftly weaving in rich sociohistorical context and analyzing the lasting legal and political impact of each judicial outcome. Over the last twenty years, no group of attorneys has helped to transform this country more than LGBT rights lawyers, and surprisingly, their collective accomplishments have received relatively little attention. Ball remedies that by exploring how a band of largely unheralded civil rights lawyers have attained remarkable legal victories through skill, creativity, and perseverance. In this richly layered and multifaceted account, Ball vividly documents how these judicial victories have significantly altered LGBT lives today in ways that were unimaginable only a generation ago.

Contemporary scholars have begun to explore non-normative sexual orientation, gender identity, and gender expression in a growing victimization literature, but very little research is focused on LGBTQ communities' patterns of offending (beyond sex work) and their experiences with police, the courts, and correctional institutions. This Handbook, the first of its kind in Criminology and Criminal Justice, will break new ground by presenting a thorough treatment of all of these under-explored issues in one interdisciplinary volume that features current empirical work.

For much of the 20th century, American gays and lesbians lived in fear that public exposure of their sexualities might cause them to be fired, blackmailed, or even arrested. Today, they are enjoying an unprecedented number of legal rights and protections. Clearly, the tides have shifted for gays and lesbians, but what caused this enormous sea change? The decision to have a child is seldom a simple one, often fraught with complexities regarding emotional readiness, finances, marital status, and compatibility with life and career goals. Rarely, though, do individuals consider the role of the law in facilitating or inhibiting their ability to have a child or to parent. For LGBT individuals, however, parenting is saturated with legality - including the initial decision of whether to have a child, how to have a child, whether one's relationship with their child will be recognized, and everyday acts of parenting like completing forms or picking up children from school. Through in-depth interviews with 137 LGBT parents, Amanda K. Baumle and D'Lane R. Compton examine the role of the law in the lives of LGBT parents and how individuals use the law when making decisions about family formation or parenting. Baumle and Compton explore the ways in which LGBT parents participate in the process of constructing legality through accepting, modifying, or rejecting legal meanings about their families. Few groups encounter as much variation in access to everyday legal rights pertaining to the family as do LGBT parents. This complexity and variation in legal environments provides a rather unique opportunity to examine the manner in which legal context affects the ways in which individuals come to understand the meaning and utility of the law for their lives. The authors conclude that legality is constructed through a complex interplay of legal context, social networks, individual characteristics, and familial desires. Ultimately, the stories of LGBT parents in this book reflect a rich and varied relationship between the law, the state, and the private family goals of individuals.

While medical identification and treatment of gender dysphoria have existed for decades, the development of transgender as a "collective political identity" is a recent construct. Over the past twenty-five years, the transgender movement has gained statutory nondiscrimination protections at the state and local levels, hate crimes protections in a number of states, inclusion in a federal law against hate crimes, legal victories in the courts, and increasingly favorable policies in bureaucracies at all levels. It has achieved these victories despite the relatively small number of trans people and despite the widespread discrimination, poverty, and violence experienced by many in the transgender community. This ethnography explores what transnational LGBT human rights advocates actually do on a day-to-day basis. Drawing on thirteen months of field research at the International Gay and Lesbian Human Rights Commission (IGLHRC), the book explores how the first transnational LGBT human rights NGO formed and evolved, who is engaged in this work, how they conceptualise LGBT human rights, what they do to promote LGBT human rights transnationally, and how they have institutionalised their views at the UN and elsewhere.

Violence against lesbians and gay men has increasingly captured media and scholarly attention. But these reports tend to focus on one segment of the LGBT community--white, middle class men--and largely ignore that part of the community that arguably suffers a larger share of the violence--racial minorities, the poor, and women. In Violence against Queer People, sociologist Doug Meyer offers the first investigation of anti-queer violence that focuses on the role played by race, class, and gender.   Drawing on interviews with forty-seven victims of violence, Meyer shows that LGBT people encounter significantly different forms of violence--and perceive that violence quite differently--based on their race, class, and gender.  His research highlights the extent to which other forms of discrimination--including racism and sexism--shape LGBT people's experience of abuse. He reports, for instance, that lesbian and transgender women often described violent incidents in which a sexual or a misogynistic component was introduced, and that LGBT people of color sometimes weren't sure if anti-queer violence was based solely on their sexuality or whether racism or sexism had also played a role. Meyer observes that given the many differences in how anti-queer violence is experienced, the present media focus on white, middle-class victims greatly oversimplifies and distorts the nature of anti-queer violence. In fact, attempts to reduce anti-queer violence that ignore race, class, and gender run the risk of helping only the most privileged gay subjects. Many feel that the struggle for gay rights has largely been accomplished and the tide of history has swung in favor of LGBT equality. Violence against Queer People, on the contrary, argues that the lives of many LGBT people--particularly the most vulnerable--have improved very little, if at all, over the past thirty years.

The right of same-sex couples to marry provoked decades of intense conflict before it was upheld by the U.S. Supreme Court in 2015. Yet some of the most divisive contests shaping the quest for marriage equality occurred not on the culture-war front lines but within the ranks of LGBTQ advocates. Nathaniel Frank tells the dramatic story of how an idea that once seemed unfathomable?and for many gays and lesbians undesirable?became a legal and moral right in just half a century. Awakening begins in the 1950s, when millions of gays and lesbians were afraid to come out, let alone fight for equality. Conservative opponents of LGBT equality in the United States often couch their opposition in claims of free speech, free association, and religious liberty. It is no surprise, then, that many LGBT supporters equate First Amendment arguments with resistance to their cause. The First Amendment and LGBT Equality tells another story, about the First Amendment's crucial yet largely forgotten role in the first few decades of the gay rights movement. Between the 1950s and 1980s, when many courts were still openly hostile to sexual minorities, they nonetheless recognized the freedom of gay and lesbian people to express themselves and associate with one another. Successful First Amendment cases protected LGBT publications and organizations, protests and parades, and individuals' right to come out. The amendment was wielded by the other side only after it had laid the groundwork for major LGBT equality victories. Carlos A. Ball illuminates the full trajectory of this legal and cultural history. He argues that, in accommodating those who dissent from LGBT equality on grounds of conscience, it is neither necessary nor appropriate to depart from the established ways in which American antidiscrimination law has, for decades, accommodated equality dissenters. But he also argues that as progressives fight the First Amendment claims of religious conservatives and other LGBT opponents today, they should take care not to erode the very safeguards of liberty that allowed LGBT rights to exist in the first place.

This volume, the only work of its kind, provides a bibliometric analysis of legal scholarship to evaluate scholarly trends, patterns, and the development of major themes and voices.
