What is Trans Day of Visibility? 👓

International Transgender Day of Visibility is celebrated each year on March 31st. This day is observed both by the transgender community and its supporters in celebration of transgender individuals, history, and progress. The day also marks as an awareness campaign against the discrimination of transgender people across the globe by bringing us visibly forward to foster change and acceptance for the human beings we are.

Over the last 18 months, over 400 pieces of legislation have been introduced and are currently being considered and voted upon in legislative bodies all across the United States. They are based on fear, deceit, and the vilification of transgender youth and adults. They look to strip parents and doctors of their right to access and provide healthcare, just like they are doing with a women's right to choose medical abortion.

If you know a transgender person, reach out to them and let them know they are seen for who they are, not as they are demonized to be. Show your support and speak out, for us all, because trans rights are human rights.

FACT SHEET: Biden-⁠Harris Administration Advances Equality and Visibility for Transgender Americans
Today, the Biden-Harris Administration recognizes Transgender Day of Visibility, an annual celebration of the resilience, achievements, and joy of transgender people in the United States and around the world. Every American deserves the freedom to be themselves. But far too many transgender Americans still face systemic barriers, discrimination, and acts of violence. Today, the Administration once again condemns the proliferation of dangerous anti-transgender legislative attacks that have been introduced and passed in state legislatures around the country. The evidence is clear that these types of bills stigmatize and worsen the well-being and mental health of transgender kids, and they put loving and supportive families across the country at risk of discrimination and harassment. As the President has said, these bills are government overreach at its worst, they are un-American, and they must stop.

Trans Rights Are Women's Rights

Each year, business and political leaders from around the world gather in Davos, Switzerland, to attend The World Economic Forum Annual Meeting. This year, a WEF affiliate session on the topic of “Coming Out as a Public LGBTQ Corporate Ally” was organized by Accenture, GLAAD, Open for Business, and the Partnership for Global LGBTQI Equality.

Representation Matters! 📜

In its examination of transgender representation on Television, the organization GLAAD found that since 2002, 102 episodes of scripted television featured trans characters and/or storylines. Of those 102 episodes, 54% were categorized as containing negative representations, 35% were categorized as problematic and a mere 12% were categorized as groundbreaking or accurate trans representation (Victims or Villains, n.d.).

The GLAAD examination also found that 40% of transgender characters were cast in a victim role and 21% were cast as killers or villains. In terms of profession, 20% of transgender characters were given the role of sex worker. In regards to language, 62% of the episodes cataloged featured anti-transgender slurs, language, and dialogue.

In GLAADs 17th annual report, Where We Are On Tv, which tracked representation from June 1, 2021, to May 31, 2022, they found that there were 42 regular/recurring trans characters across broadcast, cable, and streaming platforms. Of those 42 characters, 20 are trans women, 14 are trans men and 8 are non-binary trans (Gardner, 2022).

On June 15, 2020, the Supreme Court ruled in Bostock v. Clayton County, in a 6-to-3 decision with a majority opinion authored by conservative Justice Neil Gorsuch, that Title VII of the Civil Rights Act of 1964 prohibited employment discrimination on the basis of gender identity and sexual orientation. The decision was a surprise to many, if not most, observers, but as Jason Pierceson explores in this work, it was not completely unanticipated. The decision was grounded in a recent but well-developed shift in federal jurisprudence on the question of LGBTQ+ rights that occurred around 2000, with gender identity claims faring better in federal court after decades of skepticism. The most important precedent for these cases was a 1989 Supreme Court case that did not deal directly with LGBTQ+ rights: Price Waterhouse v. Hopkins. The court ruled in Price Waterhouse that "sex stereotyping" is a form of discrimination under Title VII, a provision that prohibits discrimination in employment based upon sex. Ann Hopkins was a cisgender, heterosexual woman who was denied a promotion at her accounting firm for being too "masculine." At the time of the decision, and in the wake of the devastating decision for the LGBTQ+ movement in Bowers v. Hardwick (1986), the case was not viewed as creating a strong precedential foundation for LGBTQ+ rights claims, especially claims based upon sexual orientation. Even in the context of gender identity, the connection was not made to the emerging movement for transgender rights until a decade later. In the 2000s, however, federal courts were consistently applying the case to protect transgender individuals. While not the result of coordinated litigation, nor initially connected to the LGBTQ+ rights movement, Price Waterhouse has been one of the most important and powerful precedents in recent years outside of the marriage equality cases. Before Bostock tells the story of how this "accidental" precedent evolved into such a crucial case for contemporary LGBTQ+ rights. Pierceson examines the groundbreaking Supreme Court decision of Bostock v. Clayton County through the legal path created by Title VII of the Civil Rights Act of 1964 and the interpretation of the word "sex" over time. Focusing on history, courageous LGBTQ+ plaintiffs, and the careful work of legal activists, Before Bostock illustrates how the courts can expand LGBTQ+ rights when legislators are more resistant, and it adds to our understanding about contemporary judicial policymaking in the context of statutory interpretation.

In tracing the twinned genealogies of blackness and transness, Snorton follows multiple trajectories, from the medical experiments conducted on enslaved black women by J. Marion Sims, the "father of American gynecology," to the negation of blackness that makes transnormativity possible. Revealing instances of personal sovereignty among blacks living in the antebellum North that were mapped in terms of "cross dressing" and canonical black literary works that express black men's access to the "female within," Black on Both Sides concludes with a reading of the fate of Phillip DeVine, who was murdered alongside Brandon Teena in 1993, a fact omitted from the film Boys Don't Cry out of narrative convenience. The Death and Life of Marsha P. Johnson

When Stonewall Veteran and beloved Greenwich Village personality Marsha P Johnson turned up dead shortly after Gay Pride in 1992, it was the latest in a series of murders, gay bashings, and "mysterious" deaths in the local gay community. Johnson is seen in footage at a political march shortly before this, at an action trying to draw attention to these hate crimes. Tragically, Johnson then becomes the next victim. Like the other suspicious deaths, Johnson's death is quickly dismissed as a "suicide", even though there is no evidence that Johnson was suicidal, and significant evidence that Johnson was harassed and stalked on that very night. Demonstrations are held to protest the lack of police investigation, but it is not until decades later that transgender crime advocate Victoria Cruz succeeds in getting some answers. Even after decades, many contemporaries of Johnson are still afraid to discuss on the record what happened to Johnson, the murders that took place in the Village in that era, the danger that follows many of the most marginalized in the community, and the threats that some still fear. Like the previous documentary on Marsha P Johnson, Pay it No Mind, this film relies on archival footage of the dead, letting the subjects speak for themselves. Footage of Johnson at political actions is included, though some might not notice Johnson at first at some of these actions and memorials, dressed down in jeans and a t-shirt, or jeans and a flannel shirt, with no wig. Stonewall veterans, AIDS activists, and early gender nonconforming and transgender activists are shown at these demonstrations, as well. The Gay Liberation Rally, where Sylvia Rivera gives the fiery "You Listen Up!" speech is also featured, along with with other interviews with Rivera and AIDS memorials with ACT UP and Gay Men's Health Crisis.
